A 32-year-old man pleaded guilty in Prince William Circuit Court on Monday to raping a 10-year-old girl.

Jose Abel Zelaya-Ascencio, of no fixed address, was charged with raping the girl at her family’s home in the 7500 block of Alleghany Court on Oct. 22, 2007.

According to court testimony Monday, the girl was awakened at 5:35 a.m. that morning when Zelaya-Ascencio broke into the house and went into her bedroom.

The girl, who was home alone with her 7-year-old brother, said she tried to get away, but Zelaya-Ascencio overpowered her and raped her, police said.

The girl told police that her attacker wore a bandanna over his face, but she suspected it was Zelaya-Ascencio, who had rented a room at her house prior to the incident.

Zelaya-Ascencio denied being at the house that morning and being involved in the rape, but DNA evidence linked him to the crime scene, police said at the time.

Prosecutors are recommending that Zelaya-Ascencio be sentenced to 20 years in prison, with 10 years suspended, and 10 years of probation.

His sentencing hearing is set for March 6.

Zelaya-Ascencio is an illegal immigrant from El Salvador and could face deportation, officials said.

Perhaps you should study an issue before declaring absolutes. The Contitution itself claims only a $10 entrance fee. I think, with inflation, $2000 for the basic fee as recommended by by McCain, Kennedy, and many others would be very useful. Taking DNA and fingerprints alone would help greatly.

We have 12 million illegal immigrants of which seven million may not be paying taxes or social secuity. That is a sizable sum of money.

Of that 12 million, less than 1% become involved in crimes. Overwhelmingly, it is US citizens who commit crimes.

Those Hispanics in prison are FAR MORE LIKELY to be U.S. citizens, bred and born right here with many generations of U.S. citizens in their lineage. In some cases, they were here before there was a U.S.

OVERWHELMINGLY, sex offenders are Whites who are middle-aged and middle class.

Easy answer if it cost 10 dollars then they documented you that would be legal, i have no issue with that. Blue doggette if this individual were not here it wouldn’t have happened. If the people would rise up against their governments, druglords, soldiers, you know Revolution, instead of transporting their pain, crime and sorrow to the north. Is it right to take from one trying to survive to give to another. I don’t think so. If you help them in anyway that is against criminal statutes then you are a criminal Blue its that simple. Nobody wants these child rapists, but if you contiue to want them imported then you are culpable not only for criminals but job losses as well as reduced salaries, healthcare, social services. Most of the Mexicans i see speak Spanish, were their indigenous peoples killed off by the Spanish Conquistadors? How come their ancestors came from the north the west and the east. Check the DNA record, lots of evidence there. Looks like no one is truely native to the Americas, with Indians coming from the north, Europeans from the east and Asians coming from the west.  Civilization began in the Mideast according to the fossil record, accept it, unless you have fossil evidence or records that it didn’t? Getting back to the case, if they really have DNA Identification evidence, why did they let him plea down from 20 years to ten? They already admit they do not have witness identification based on the bandana.

There is something fishy about any case where they do that. That he will be deported after that adds to the issue. This sounds like a political favor.

THEN it is bogus information.

The median income per household is less than $43,000, just to start with. “Median” means 50% are above that and 50% are below that. I do NOT believe they are quoting ANY governmental source.

You’d be surprised what some of these online .ORG types are claiming, including the very opposite of what you and they are claiming.

My point is that they should pay the cost of entrance, taxes, and social security - which they are not doing now.

They are paying NO social security, which those who make above the median income are maxed out. They pay a maximum amount and no more. If you think social security is a small part (which does not figure into taxes) then you need to look at your last tax return again.

“If they could pay taxes like other citizens, they would pay for themselves.“  What do you base that on?  According to the tax foundation the top 25 percent of taxpayers (AGI over $64,702) paid more than four out of every five dollars collected by the federal income tax (86.3 percent). Unless these illegal immigrants will be making over 65 grand a year, I believe we will be taking care of them for a long time.

You know, Mel, I kinda agree with you. My folks started complaining about those boat people since 1492.

Of course, there are those pesky ancestors of mine that came over as slaves in bondage. They refer to themselves as Scots-Irish or Irish Americans now. Then, they were treated like ballast. In one case 11 got cholera. They buried all 157 of them in a mass grave. Pretty savage infection control in those days.

Then there is my father’s bunch - likely escaping pogroms. My father was not a Nobel Prize winner, lawyer, or doctor, though. At seven he was a windmill maintenance man. He was a jack of all trades except farming and died at 38.

When the Constitution was ratified, you only had to pay ten dollars to register when you came in. It was not until the 1920s they had all these immigration laws.

Most of the Mexicans I see are Natives rather than Spanish. Their people have not been this far north since the last Ice Age.

If they could pay taxes like other citizens, they would pay for themselves.

Something that really pisses me off is the fact that most of these illegal immigrants can’t “pay” a defense attorney, so we Americans are stuck paying their bill.

If they weren’t here in the first there would be no discussion.

Still waiting to hear how I am a criminal or what I have done to aid illegal aliens there CC.  Does the fact this topic is nearly a month old say anything? 

YOU, CC, have no idea who is legal and who is illegal.  People don’t wear their immigration status branded on their foreheads. 

You obviously don’t care about children in general or you would want to jail this creep rather than have him loose in his own country preying on little girls there.  Or maybe its ok because of where he is from?
