Man pleads guilty to rape of girl, 10

A 32-year-old man pleaded guilty in Prince William Circuit Court on Monday to raping a 10-year-old girl.
Jose Abel Zelaya-Ascencio, of no fixed address, was charged with raping the girl at her family’s home in the 7500 block of Alleghany Court on Oct. 22, 2007.
According to court testimony Monday, the girl was awakened at 5:35 a.m. that morning when Zelaya-Ascencio broke into the house and went into her bedroom.
The girl, who was home alone with her 7-year-old brother, said she tried to get away, but Zelaya-Ascencio overpowered her and raped her, police said.
The girl told police that her attacker wore a bandanna over his face, but she suspected it was Zelaya-Ascencio, who had rented a room at her house prior to the incident.
Zelaya-Ascencio denied being at the house that morning and being involved in the rape, but DNA evidence linked him to the crime scene, police said at the time.
Prosecutors are recommending that Zelaya-Ascencio be sentenced to 20 years in prison, with 10 years suspended, and 10 years of probation.
His sentencing hearing is set for March 6.
Zelaya-Ascencio is an illegal immigrant from El Salvador and could face deportation, officials said.

John why would you steal another countries laborers and use them like slaves for less than minimum wage? They could be building up their own countries and making themselves stronger in the process instead of freeloading of the backs of legal taxpayers and workers. Why why why?

We did that here it was called the Revolution and the Civil War. Both of these actions made this country the strong and unified country it is, more so than any other country considering many other countries don’t have a Constitution like ours.

I certainly don’t question a legal aliens right to be here, but by law and for justice i do question why illegal aliens are here stealing jobs, stealing identities, driving, buying or renting homes, stealing benefits, committing crimes and yes they committ crimes like the man accused here. Death penalty or deportation it makes no difference to me, better than having them here which is what Blue doggettes’ activities and witty sayings encourage. Don’t fool yourself blue doggette i am very relevant here and very lawfully right and the man is getting a fair trial and due process, that isn’t even the issue. Why was he here in the first place that is the issue. Don’t try to change the subject and or confuse it with a legal alien.

Chris, You are deluded and you must have me confused with someone else that you think you know. Please explain to me how I have aided illegal aliens? That is doggette, not coyote.
We are changing the subject because you are irrelevant. The only thing I want is the man to have a fair trial which involves due process. If found guilty, I am all for whatever the criminal justice system sentences him to. I would hope it would be forever. I don’t want him deported until he serves his sentence. Why would I want some child in some other country raped?
I would never want to get into legal difficulties in another country. I have heard very bad stories over the years, some including places I thought were civilized.
Just looking at what went on in Aruba in the Natalie Holloway case is a glimpse into why the American legal system, albeit flawed, is one of the best, if not THE best, in the world.

I have no delusions that we have a perfect system of due process. We do know what it means, how important it is, and work hard at making it happen. I know some get more of that than others in the US.
Our criminal justice system can be really bad and yet it is the best.
I email citizens in the UK and they do not have a formal Constitution like ours. They must work only on common law, because individual rights to press and other liberties are not even near full.
A friend of mine spent some time in a Mexican jail. His report of justice there was not good, and he really did not understand what he was telling me, so it was not just denial.
A man who worked for me got tossed into a Phillipine jail. He broke out a headlight. I paid for the headlight and he got out.
When we went to the jail cell, it had no bathroom and was packed beyond “standing room only.“ He squeezed his way out from the middle of the crowd. When I looked at the floor, I would have been sleeping standing up too.
If this man in this case is guilty, I do not want to send him back to his country. I do not want children abused there either. I want him to be working in a prison for the rest of his life.
If he is NOT guilty, that means a sex offender may be still out there abusing children.
I do not believe in making examples or myrters (sp). I do not believe in vindicating with vindictiveness.
Certainly, we do not want to make a hero of a thief of public servies either. If we identified (DNA & fingerprints included) aliens, we could make them pay for processing, social security, and taxes rather than working “under the table.“ We could use those taxes to control who crosses out borders - from overseas, Mexico, and Canada. Build a big fence. Make them walk through a gate. Stop Drugs. Stop terrorists.
Until the later part of this year, we just did not have enough of general laborers. We will need them when things turn up again. Why employ and educate them only to let them to return? We have an investment in them. We are the MOST PRODUCTIVE NATION IN THE WORLD. Why let them go back to countries that are not as willing and able to use all that productivity.
At this point, the borders are a swinging door that you could ride an elephant and marching band through. It was done.
The only people I want to go to Mexico are felons. In fact, I would be willing to send some citizens that do not work/contribute here. It would be a reality orientation for them.
Of course, some the hardest workers I have EVER had work for me did not speak English well and they were LEGAL aliens.

John, I think that there are many people out there felling all proud of themselves that they are such good Americans, yet they would deny one of our cornerstones of democracy to those who don’t ‘belong,‘ to those who are immigrants, legal or illegal.
All people on American soil are entitled to due process. That is reason we are such a great country. Most countries only reserve such luxuries for the in-crowd.

What I SAID was you consider getting the last word a blood sport….and I do mean on any subject. I haven’t followed your endless prattle. If I did I would be as nuts as you are, now wouldn’t I?
I don’t think anyone is fooled by your minimization and denial.
I would say for you that anyone interested in due process and justice is a “bleeding heart” to you, but the evidence is that anyone who disagrees with you would get that label from you.
You keep declaring yourself a “winner,“ but with every post you prove otherwise.
In the case of this man, you would differientiate between illegal aliens and citizens as to whether they receive due process. The U.S. Supreme Court has found everyone has a right to due process. That is why there has been such a problem with GITMO.
