Prosecutors on Monday dropped an election fraud charge against Manassas Park councilman Peter Farrell, who resigned his seat Friday.

Farrell, 51, had been charged with lying about being a Manassas Park resident when he ran for his seat on the city council last year.

In a press release Monday, Farrell stated that while he was living in Manassas Park at the time of the election, he is now spending more time at a residence outside of the city.

In documents submitted to the Manassas Park voter registrar before and after the election, Farrell listed his home address as 9301 Joshua Court in Manassas Park.

“The big point that I want to make is that I — 100 percent, absolutely — lived in Manassas Park when I ran for election and was elected, and I provided overwhelming evidence to prove that to the prosecutors,” Farrell said.

Farrell, a Democrat, was elected to the council in 2008.

He was scheduled to stand trial Monday, but prosecutors declared the charge nolle prosequi, meaning they do not wish to prosecute him at this time. The charge can be brought again at a later time.

Prosecutors did not comment on their reason for dropping the case.

Farrell said he believed the charge against him stemmed from the fact that he requested a study “regarding the amount of taxpayers’ money being spent for the city’s legal services to Manassas Park City Attorney Dean Crowhurst’s law firm.”

“I got along well with the governing body. I think we had a good professional working relationship, but I did have a conflict with the city attorney,” Farrell said.

Manassas Park Mayor Frank Jones said the charges had nothing to do with Farrell’s request for a study.

“I am absolutely appalled. That is blatantly deceitful and misrepresentative,” Jones said. “There was no linkage between the two at all.  Mr Farrell’s behavior —  that the commonwealth attorney acted on —  was Mr. Farrell’s and had no relationship to any of the discussions about any of the contracting for services across the city.”

Crowhurst said it was his “policy” to avoid talking about past or present members of council because of his “close relationship with the city council and the mayor.”

“However, because Mr. Farrell has challenged my integrity in his press release, I feel compelled to state clearly that his allegations are categorically untrue,” Crowhurst said. “Furthermore,  I want to point out that I am not the city’s prosecuting attorney. [Prince William County Commonwealth’s Attorney Paul Ebert] is, and his office chose to prosecute Mr. Farrell based on the evidence, and the grand jury handed down an indictment based on the same evidence.”

Farrell, the owner of Peter Farrell Supercar Inc. on Manassas Drive, said area residents should still expect to see him about town.

“I’m still going to be around, but just as a business man. Instead of sitting on the bench, I’ll sit on the other side,” he said.

Farrell said the decision to leave was not made easily.

“I do have some regrets because I really felt I was doing good service for the citizens and bringing another viewpoint to the table that isn’t always brought to the table,” he said.

Jones said a couple of things have to happen to get a replacement for Farrell.

“We have to petition the courts for a special election and we have to appoint an interim until such time as a special election is held,” Jones said. “The interim appointment, I believe, has to be made within 45 days.”

The court usually tries to dovetail special elections into the next upcoming election, Jones said.

The city council normally interviews people who are interested in the job and then appoints a replacement, Jones said.

First of the 9301 Joshua Court is owned by BROTTEN ROBERT since at since 12/07/2009 and before that by RANATHA BOGGS of 137 lambert court. He never owned a home in Manassas Park

I never said he didn’t own the property in question, just that he didn’t maintain that address as a domicile. A picture of his vehicle at a house he owned is not proof of residence.  Knowing where he actually spent the night is.  I never take stock in gossip and only believe what I have seen or can prove.  And Ron, the charges were not dropped, Ebert just declined to prosecute Farrell at this time.  If you’ve never heard of it, it’s called a plea bargain. The idea is to save money when the verdict is a forgone conclusion or damaging the City’s reputation by letting this happen. Mr. Miller, I don’t have to prove anything to you or anyone else since I KNOW the truth, not rumors. And one fact you might consider, except I know you won’t, knowing Farrell’s personality,do you honestly believe he would resign rather than pass up a chance to save his reputation by proving the charges false.

Do you have any proof to support your allegation or are you depending on gossip you may have heard? Why don’t you visit the city Real Estate assessment site and look up 9301 Joshua Court. You will see a picture of his house with his three vehicles parked in the driveway. The blue Mazda van is still at his dealership today.

I certainly hope you never serve on a jury because you are awful fast to convict somebody without having evidence other than gossip.

I am a democrat, voted for Farrell and believe this to be a big loss to the citizens of Manassas Park. They finally had somebody representing them that did not just march lockstep with the old guard.

Farrell did not maintain a domicile in Manassas Park, he had a room in one of the townhomes he owned.  This is not a domicile since he just maintained a bed and an address. He went home out of the City every night. Read the State Code.  As far as I am concerned he is guilty of election fraud, voter fraud, perjury, fraud in collecting his monthly stipend, violating the confidentiality of any and every employee action that was discussed during executive session of Council, and out and out stupidity in thinking no one was going to find out about his true residence. Since I don’t belong to any political party, going after Farrell for these violations is no more or no less than I would do to ANYONE who did the same thing.  How about you Mr. Miller, which political party do you support.  Manassas Park is too small for party politics, we need good PEOPLE, not good politicians.

Mr. Murphy….You appear to have first hand knowledge in this case. So what crime do you believe was committed here? I know Farrell and have seen evidence that proves his domicile in MP since 2005 until after he was elected.

Maybe you can enlighten me to the true agenda behind going after Farrell. Did you not like the positions he took on city matters or what?

As usual Ron hasn’t the foggiest idea what he is talking about.  Just for the record, I actually live in Manassas Park and voted for Farrell.  Shortly after the election I found out that, although he owned various properties in the City, he did not maintain a “domicile” as required for citizenship.  After considerable investigation by several CITIZENS of the city, all the information was provided to Paul Ebert, who presented it to a grand jury and they indicted Farrell for election fraud. Instead of dropping the charges, I would add several; 2 counts of perjury and a civil suit by all the residents of Manassas Park who voted for him. His fraud caused the voters to waste their vote on a candidate who was not eligible to hold office.  One other detail I would like to set straight, Vonnie Privitt resigned after serving several consecutive terms as a City Council member
