BALTIMORE (AP) — Baltimore police say they don't believe a Johns Hopkins University student had "the intent to kill" when he took a samurai sword to confront an intruder on his property.
Twenty-year-old John Pontolillo of New Jersey ended up killing a man with the sword in the fenced courtyard behind his off-campus home, which he shares with three other students.
Police say the intruder lunged at Pontolillo, who killed him with a single blow from the sword. The 49-year-old suspected burglar, Donald Rice, died at the scene.
Pontolillo has not been charged with a crime. Police have said they're consulting with prosecutors.
While police initially reported Rice was hiding in a detached garage behind the home, they said Thursday he was hiding in a courtyard.
