Prosecutors have filed a motion to drop felony charges against two bartender who performed a fire-breathing trick at a Herndon bar, according to court records.

Manassas resident Justin Fedorchak and Tegee Rogers, of Herndon, both bartenders at Jimmy's Old Town Tavern in Herndon, were each charged with three felonies after a Fairfax County fire marshal saw them breath fire at the tavern on July 24.

The men were charged with manufacturing and using an explosive device, setting a fire capable of spreading, and burning or destroying a meeting house.

Fairfax County Commonwealth's Attorney Ray Morrogh said his office plans to drop those charges, Virginia Lawyer's Weekly reported Wednesday.

Rogers, 33, and Fedorchak, 39, both still face three misdemeanor charges of violating the state fire prevention code.

Jimmy's Old Town Tavern owner Jimmy Cirrito, who lives in Manassas Park, said bartenders have been performing the fire-breathing trick there without incident for 13 years.
